In a stunning victory, the California Coastal Commission conditioned SeaWorld San Diego’s expansion of orca tanks (called by SeaWorld the “Blue World Project”) on SeaWorld ending breeding or moving captive orcas into California, effectively telling SeaWorld to phase out captive orcas.

A group of scientists has come together to propose that the Commission add a condition to the permit approval in which SeaWorld would no longer breed orcas in captivity in San Diego. The condition would further restrict SeaWorld from bringing in or removing any captive orcas from their San Diego facility, with exceptions for retirement of captive orcas to a sea pen and for bringing in stranded and sick individuals for rehabilitation and return to the ocean.

We at Earth Island and activists dedicated to ending the captivity of cetaceans are celebrating the victory in federal court in Atlanta. In a huge win, Judge Amy Totenberg denied the Georgia Aquarium the permit they sought in order to import 18 wild-caught beluga whales from a population in Russia that is sorely depleted.
"This federal court ruling is a stunning rebuke to every captive whale facility that tries to profit off ripping belugas, orcas and other marine mammals from the wild, despite cruel capture methods and damage to their populations,” stated David Phillips, Director of the International Marine Mammal Project of Earth Island Institute.
The court victory has many ramifications. Russia, along with Taiji, Japan, and Cuba, is becoming a major source of captive marine mammals, as other sources around the world have either been depleted or closed to the dolphin trade by activists and governments.

Sale of live dolphins caught in the bloody Cove of Taiji, Japan, subsidizes the subsequent slaughter of the remaining dolphin pod. So a dolphin is torn from its family, and then will hear its own family die as it is dragged away to a miserable existence in concrete tanks for the rest of its life.

TAIJI DOLPHIN SLAUGHTER: Police in Taiji like to put on a big show for locals by charging around in zodiacs, pretending to catch "eco-terrorists" who might (but never have) interfered with the dolphin slaughter. To them, the hunts are a big joke. Japanese tax dollars at work!

The recent International Whaling Commission meeting in Lima, Peru, passed an excellent resolution complaining that whaling countries -- Japan, Iceland and Norway -- are using population estimates larger than the IWC Scientific Committee. But a proposal for a South Atlantic Whale Sanctuary fell short by one vote.

The last captive orca in Canada, Kiska, has died, after being kept alone for twelve years at the notorious MarineLand park in Niagara Falls. If Tokitae (Lolita) goes home to a seaside sanctuary, the only North American captive orcas will be those in SeaWorld's three parks.

There are just 18 orcas left stranded in concrete tanks in North America. They can continue to languish in small tanks doing tricks each day, or they can be retired to seaside sanctuaries, such as the Whale Sanctuary Project.
